These Terms of Service (“Terms”) govern your use of the CeCe Freade™ website (the “Site”), our online store, and any related services (collectively, the “Services”) operated by Freade Inc. d/b/a CeCe Freade™ (“CeCe Freade,” “Company,” “we,” “our,” or “us”). These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles.
12. Arbitration
PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR RIGHTS.
You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof or the use of the Services will be resolved by binding arbitration, except that each party retains the right to bring an individual action in small claims court.
You and CeCe Freade™ agree to waive the right to a trial by jury or to participate as a plaintiff or class member in any purported class action or representative proceeding. Unless both you and CeCe Freade™ otherwise agree in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of any class or representative proceeding.
The arbitration will be administered by the American Arbitration Association ("AAA") in accordance with the Consumer Arbitration Rules. The arbitration will be held in New York County, New York.
13. Changes to These Terms
We may update these Terms from time to time. The “Effective Date” above will reflect the latest revision. Continued use of the Site after changes means you accept the updated Terms. If you do not agree to the updated Terms, you should stop using the Services.
14. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published by us on the Site, shall constitute the entire agreement between you and CeCe Freade™ concerning the Services.
15. No Waiver
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and CeCe Freade's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
